Scott O’Connor was called upon as an expert witness to ascertain whether a real estate transaction had been a purchase or a lease of the property.
The parties employed a contract for sale, which is familiar to real estate practitioners who have recently taken a basic class on real estate, but rarely used in practice. Hence, third parties and some of the principals failed to recognize the deal for what it was.
By explaining how it was obviously a contract for sale, how those work, and tying it to the facts in evidence and the numbers, O’Connor’s client won substantially all of the legal relief sought in the trial. The judge ruled that O’Connor’s testimony was both credible and very helpful to the Court.
